1) Scope
This Privacy Policy explains how DataCycle, LLC. ("VMProperty," "we," "us") collects, uses, discloses, and protects personal information when you use our websites, apps, and services (the "Service").
2) Information We Collect
A) You provide
- Account details (name, email, phone, role), profile photo.
- Property, unit, and lease data (rent amounts, fees, notices, ledgers).
- Applicant/tenant data (applications, references, employment/income, SSN/Tax ID if you choose to collect, rental history).
- Payment details (bank/card info handled by processors), tax forms (e.g., W‑9 for owners/vendors), receipts.
- Communications (support requests, maintenance tickets, messaging), uploaded files/photos.
B) Automatically collected
- Device/usage data (IP address, device identifiers, app version, pages/screens viewed, timestamps, referrers, crash logs).
- Cookies and similar technologies for session management, security, analytics, and fraud prevention.
C) From third parties (as applicable)
- Payment processors/ACH providers (tokenized payment data, payment status; we typically do not receive full bank/card numbers).
- Identity verification and tenant‑screening providers (verification status, consumer reports).
- Analytics, communications, and support vendors.
3) How We Use Information
- Provide, operate, secure, and improve the Service.
- Facilitate payments, payouts, refunds, and collections; detect and prevent fraud.
- Enable applications, screenings, leasing workflows, and communications among connected users.
- Send transactional messages (rent reminders, receipts) and, with consent, marketing communications.
- Personalize experience and measure performance.
- Comply with legal obligations (tax reporting, recordkeeping) and enforce our Terms.
4) Sharing & Disclosures
We may share information with:
- Service providers/processors (hosting, analytics, communications, payments/ACH such as Stripe or Helcim, identity/screening). They must use data only to perform services for us.
- Connected users as needed for property management (e.g., landlords view applications and ledgers; tenants view charges, leases, and communications).
- Business partners you choose to connect (e.g., accounting tools, listing syndication).
- Legal/compliance to comply with law, lawful requests, or protect rights, property, or safety.
- Corporate transactions (merger, financing, acquisition, dissolution). We will notify you if required by law.
We do not sell personal information. If we ever "share" data for cross‑context behavioral advertising, you may opt out where available.
5) Payments & Financial Data
- Card and bank data are processed by our payment processors/ACH providers. We generally receive tokens and the last 4 digits, not full numbers.
- You authorize processors to store and use your payment method consistent with their terms and network/NACHA rules.
6) Tenant Screening & FCRA (If Enabled)
- If you request consumer reports, you certify a permissible purpose and agree to use reports only for the stated purpose and keep them confidential.
- Adverse‑action obligations remain with the decision‑maker (usually the housing provider).
7) Cookies, Analytics & "Do Not Track"
- We use cookies and similar technologies for authentication, analytics, and security.
- Browser "Do Not Track" signals are not consistently honored across the industry; we do not respond to them.
- You can control cookies in your browser; disabling some may break features.
8) Data Retention
We retain information as needed to operate the Service, comply with legal obligations (including tax/recordkeeping), resolve disputes, and enforce agreements. Where possible, we de‑identify or aggregate data.
9) Security
We use administrative, technical, and physical safeguards appropriate to the nature of the data (e.g., encryption in transit, access controls). No system is 100% secure. You are responsible for maintaining strong passwords and restricting access to your devices and accounts.
10) Your Choices & Rights
- Access, correct, or delete certain account info in settings or by contacting us.
- Opt out of marketing emails via unsubscribe links (transactional emails are necessary for the Service).
- For tenant‑screening reports, contact the reporting agency to dispute information under the FCRA.
11) U.S. State Privacy Rights
Residents of certain U.S. states (e.g., California, Colorado, Connecticut, Utah, Virginia) may have rights to access, correct, delete, obtain a portable copy, and opt out of processing for targeted advertising, sale, or certain profiling. Contact contact@datacycle.tech with subject "Privacy Request," include your state of residence, the request type, and information sufficient for identity verification. If we deny your request, you may appeal by replying "Appeal."
California notices (CPRA): We do not sell personal information. If we ever "share" data for cross‑context behavioral advertising, you may opt out. We do not use or disclose "sensitive personal information" for purposes that require a "Limit Use" link under CPRA. We provide notice at collection and, upon request, a retention rationale by category.
12) Children's Privacy
The Service is not intended for children under 13, and we do not knowingly collect their personal information. If we learn we have collected it, we will delete it.
13) International Users
We operate in the United States. If you access the Service from outside the U.S., you understand your data will be processed in the U.S., where laws may differ from your jurisdiction.
14) Changes to This Policy
We may update this Privacy Policy. We will post the new date and, if changes are material, notify you via the app or email. Continued use after changes means you accept the updated Policy.
